A purchase contract does NOT negate MLS Coming Soon policy

A purchase agreement between a buyer and a seller does not negate a member’s obligations to follow the MLS’ Rules and Regulations, which is an independent contract existing between the member listing broker and the MLS.

If a listing is in Coming Soon status and the seller accepts a curb offer in which the buyer asks to see the property, you must ‘End Coming Soon’ before showing the property or you are in violation of MLS Policy 1.05.04 – Showing a Listing During a No Showings Allowed Period.

COCIE – Expanded Eligibility for Governing Board

COCIE Rules and Regulations have been modified to expand the number of eligible firms for COCIE Governing Board appointment. Section 3.1.1b of the Rules now allows candidates to be selected from the ten largest firms. Firm size is determined by number of active COCIE members. Previously, eligibility was limited to the top five firms. The appointments for the large firms’ open seats are expected to be made at the July COCIE Governing Board meeting.

MLS Tip: Clear Cooperation vs. Coming Soon – Simplified

Clear Cooperation and Coming Soon have been with us for quite a while now.  They are related, but definitely not the same.  Below is a very brief, easier-to-remember SUMMARY of the differences.  The intent is to create a simple way to “remind yourself” of the main differences.

Clear Cooperation:

  1. NO ADVERTISING “of any kind” outside the brokerage. 
  2. Brokerage Exclusive form is required by MLS.
  3. From the Commencing Date on the Listing Agreement through the MLS Entry Date (list date) when the listing appears in MLS and is visible to all MLS vendors.
  4. MLS Entry Date field determines when the listing “must be in MLS” but status at time of entry can be Coming Soon (ie showings NOT allowed) or Active.

Coming Soon:

  1. NO SHOWINGS “of any kind” while in Coming Soon status.
  2. Showings begin when the Active on MLS date is reached or the agent clicks the “End Coming Soon” button to convert the listing early to Active status per seller’s written direction.

These are extremely simplified definitions of Clear Cooperation and Coming Soon. Please refer to the full details published in the Policy Violation Manual and MLS Rules and Regulations.

New Help Text for Concession Comments Field

The optional field Concession Comments was added on the closing screen in MLS in March 2022. The help text below has been added to clarify the field usage.

Click on the help bubble “?” to see the text below on the closing screen.

Sales and financing concessions are the negotiated costs in a transaction that are not required to be paid by the seller or buyer.

  • Examples include:
    • Seller paid costs traditionally paid by the buyer.
    • Buyer paid costs traditionally paid by the seller.

Sewer Field will become Required in Residential

The existing Sewer field in Residential will soon be made required. This was an oversight when the field was added. Any listing that is added or edited after this update will require Private or Public to be selected in the Sewer field.

Previous notice from July 2021:

A new searchable field known as the Sewer field has been added to FlexMLS. Using this, members can indicate on their listings whether the property has a Public Sewer, or a Private Sewer. This can also be used as search criteria for quick searches. Sewer is not enabled on searches by default and must be added to your search using the Add a field to this search option at the bottom of the currently added criteria.

MLS Tip: Sold Non-MLS vs. Unrepresented Buyers: When and how to use “nonmember”

The selection “nonmember” appears in the Listing Member and Selling Member fields. It may be used when either the seller’s or buyer’s representative was not an MLS member. This may mean that the consumer was represented by a real estate agent who is not a member of the MLS or they had no agent representing them at all. “Nonmember” should be used very carefully and correctly. “Nonmember” cannot be in both fields simultaneously. An MLS member must have represented one side of the transaction.

Sold Non MLS (Unrepresented Seller):

  • Used to indicate that the seller was unrepresented or the “listing agent” was not a member of the MLS.
  • Type “nonmember” in the Listing Member field at time of entry.
  • Be sure to type it in as all one word with no spaces.
  • Sold Non-MLS listings must be ENTERED as Sold Non-MLS at time of initial Entry.
  • Listing is saved as Sold Non-MLS, not Active.
  • Cannot be entered as a normal, Active listing then closed out as Sold Non-MLS.
  • *Only Admins or Brokers can enter listings as Sold Non-MLS.*

Very Important: Do not enter a “Sold Non-MLS” listing as an Active listing. Listing Member MUST be “nonmember”.

Unrepresented Buyer:

  • Used when closing a standard listing if the buyer was unrepresented by an MLS member.
  • Type “nonmember” in the Selling Member field at time of Closing the listing.
  • Be sure to type it in as all one word with no spaces.

New MLS Field Labels

The “1st Floor Owner Suite” selection in the Rooms field has been changed to “1st Floor Primary Suite”

  • The label change was discussed in 2021 but was delayed until RESO standardized on the label replacement for “Owner Suite”.

The “Seller Concessions” field has been changed to “Seller/Buyer Concessions”

  • This change affects all property types except Res Rental.
  • The label was changed to clarify that Seller or Buyer concessions are included in the sale.

Coming: A new field called “Concession Comments” will be added in the coming weeks.

  • If “yes” is selected in the “Seller/Buyer Concessions” field, the Concession Comments field can be used to describe the type of concessions.

Data Co-op: Outage – RESOLVED

As of 9:30 am this morning Data Co-op services (RealAVM, Listing and Market Activity, Consolidated reports) are up and running.

The MLS Technical Support Team still awaits confirmation of resolution from our vendor.

CoreLogic, the vendor of Data Co-op has confirmed that the Data Co-op services (RealAVM, Listing and Market Activity, Consolidated reports) are down.

CoreLogic is working to remedy the issue and this is a top priority for resolution.
